BOOKING CONDITIONS
1.- RESERVATION AND PAYMENT
Only bookings in the name of a person are accepted (henceforth called client), bookings in the name of a company or an association are not accepted. The client and the persons who occupy the property accept the letting contract for a holiday accommodation; it can never be interpreted as a contract for a main residence. All bookings are made with Cala Marquesa Real Estate S.L. as contracting party (hereinafter called ICM) and are subject to the following conditions
1.1- To confirm the booking, a deposit of 40% of the total rent must be paid, at the time of reservation. The balance (60%) must be paid 2 weeks before arrival. Payment can be made by credit card, bank transfer, or cash as long as they do not exceed 1000 euros, thus complying with current regulations. The person who does the bank transfer has to provide the booking number and the name of the person who made the booking.
1.2- If the deposit or the final balance have not been received within the specified time, ICM holds the right to cancel the booking. There is no compromise between ICM and the client until the deposit has been received and the client has received booking confirmation via e-mail. In case of cancellation, please check point 2 “Cancellation charges”.
1.3- Cala Marquesa Real Estate S.L. rents in the name and on account of the property owner.
2- CANCELLATION CHARGES:
In case you wish to cancel the booking you have to communicate it immediately to Cala Marquesa Real Estate S.L. writing an e-mail to calamarquesa@calamarquesa.com, only then the cancellation will be valid. The scale of cancellation fees is set as follows: More than 6 weeks before check-in: 5% of the total letting amount; between 6 and 2 weeks before check-in: the amount of the deposit; 2 weeks before check-in: 100% of the total letting amount.
To avoid the application of the cancellation policy, ICM recommends to hire an insurance that guarantees the reimbursement of cancellation expenses in several cases, including Covid-19 within the terms of serious illnesses. See specifications in point 12.-“Contracting travel insurance”.
In the event that the client is affected by mobility restrictions imposed by authorities (local, regional, national or international), that prevent you from reaching the accommodation ICM will issue a voucher to the client for the amount paid that can be exchanged for the reservation of any of our properties and will be valid for up to 1 year after the start date of the reservation. The availability and dates of the same property for the following season are not guaranteed.
3- NUMBER OF PEOPLE:
The contract with you is personal. You cannot assign or grant a licence of your right to occupy the accommodation for the period of your booking or any part of such period and subletting is strictly prohibited. You are not allowed to accommodate more people than stated on your booking form without express written authorisation of Cala Marquesa Real Estate S.L.
4.- ARRIVALS AND DEPARTURES
The arrival and departure dates out of main season are completely flexible. From the second weekend of July onwards until the last weekend of August check-in and check-out in houses will always be on a Friday and the check-in and check-out at apartments will be on a Saturday. The properties are available from 5 p.m on the arrival date and have to be evacuated before 10 am on the departure date. If you are going to arrive out of office time you must contact ICM to make arrangements regarding the keys. In that case the outstanding balance as well as the deposit of the letting must have been paid in advance. For any emergency you can contact our emergency number 0034 616 431 583.
5.- BREAKAGE DEPOSITt
Upon arrival, the amount of the deposit indicated in the details of each property that appears on our website will be blocked by credit card to guarantee possible damage or loss of keys. The deposit will be returned automatically within 30 days. You will have to notify any damage you have found in the accommodation within 24 hours. The deposit will also be used in the event that the accommodation is left excessively dirty, the kitchen utensils have not been washed or garbage is left inside the property, for which 150 Euros will be charged. If any damage is found and the deposit is retained, the remaining balance will be returned by bank transfer.
6.- INCLUDED IN THE PRICE:
Supply of water, gas, electricity and final cleaning. In case the butane gas bottle is empty ICM will provide a new one without any cost in its offices.
7.- TOURIST TAX
The client must pay the tourist tax of 1€ per person and night up to a maximum of 7 nights. Children under 17 years are exempt from this tax.
8.- HIRE OF TOWELS AND SHEETS:
The accommodations do not have bedding, towels or kitchen towels. The client can bring his own linen or rent it with ICM. The rental prices are: sheets: 10 € per person. Set of towels (1 big + 1 small): 10€ per person.
If ICM detects that the client has used the beds without sheets, the amount of cleaning the bedspreads and protectors will be charged from the deposit.
9.- HIRE of COTS, HIGH CHAIRS, ETC:
Available upon request: Cot: 33 €, High chair: 20 €. Prices for the whole stay
10.- PETS
Are not allowed without the express authorization of Cala Marquesa Real Estate S.L. . The supplement for bringing pets in the accommodation where it is allowed is 60 Euros.
11.- TRAVEL CANCELLATION INSURANCE:
Cala Marquesa Real Estate S.L. puts at your disposal possibility to hire a travel cancellation insurance, which guarantees the reimbursement of cancellation expenses, when the insured person cancels for any of the 28 established reasons, including Covid-19 within the terms of serious illnesses, death, loss of employment among other causes detailed in the following link: https://calmarquesa1.attis-insurance.com/
12.- AUTHORITY AS A HOUSEHOLDER: Cala Marquesa Real Estate S.L. has the authority as a householder in any of the properties rented as well as in its offices. Failure to comply with community rules or civic regulations will immediately imply the termination of the contract and immediate eviction by the police authorities.
13.- INDUSTRIAL ACCESS: The client allows access to the property at all times by maintenance and/or industrial technicians, so that they can carry out maintenance and/or repair work on the accommodation and/or its exteriors.
14- LIABILITY:
ICM ensures that the accommodation is in good condition upon arrival. If this should not be the case/ there is any incidence, ICM will do its best to solve the problem within 24 hours (except if external technical assistance is required). ICM reserves the right to offer an alternative accommodation of the same or a higher category if, due to circumstances beyond ICM's control, the accommodation chosen by the client is not available. In the event of a natural disaster, ICM reserves the right to cancel the reservation. In this case the entire amount paid by the client would be returned.
ICM does not accept any responsibility for the following circumstances beyond the control of the company:
- Theft, loss or damage that occupants may suffer during their stay in the rented property
- Any damage caused as a result of a natural disaster.
- Noise caused by construction works in the surroundings or in the neighborhoud
- Interruption of the water, electricity, or gas supplies caused by the supplying companies
- Delay in repairing any electric domestic devices, in case we have to wait for the special technician to come
- Opening and closing dates of the pools. Clients are fully responsible for their safety during the usage of the pool
- In case the town hall closes the access to any of the beaches
- Incidents in WIFI network (in case the accommodation disposes of WIFI)
- Water restrictions imposed by the Government and/or competent administrations that may affect the state of gardens, swimming pools and consumption.

Water restrictions: We inform you that according to Decree Law 1/2023 of February 28, due to the extreme drought we are experiencing, it is forbidden to water the lawn of any private property. There are also restrictions on filling swimming pools and human consumption. Given this exceptionality, we cannot guarantee the condition of the gardens and swimming pools, nor the possible restrictions on their use. We apologize for any inconvenience this may cause. The measures to manage episodes of regional water shortages agreed by the Government of Catalonia (Generalitat de Catalunya) and/or other competent public administrations will be mandatory for both contracting parties. In compliance with the regulations, services may be affected that cannot be carried out normally. No such event will entail any type of compensation.
15.- PROTECTION OF PERSONAL DATA:
Pursuant to the provisions laid down in Organic Law 15/1999, of 13 December, on the Protection of Personal Data (LOPD), we inform you that the provided information will be included in the database owned by CALA MARQUESA REAL ESTATE S.L. With your reservation and deposit you expressly authorise ICM to send you e-mail communications and to keep you informed of our new products and services, as well as to communicate your personal data to the owner of the property you have rented, for fiscal and legal purposes. You may anytime exercise the rights granted in the LOPD over this files and, in particular, may access, amend or cancel data, and have the right to revoke consent for the transfer of your data under the terms envisaged in the LOPD, by sending your request to Avda Joan Pericot 36, 17210, Calella de Palafrugell, Girona.
This contract is governed by Spanish regulations and jurisdiction. In the event of a conflict over the interpretation and / or execution of this contract, the parties submit to the jurisdiction of the courts of justice of Bisbal d'Empordà renouncing their own jurisdiction if this were another.
